The NBA legend Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over alleged violations of antitrust rules.
Team Investment and a Will to Win
The owner disclosed financial and corporate details of his 23XI team, saying he invested $40 million of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”
The Core Dispute: Franchise System and Renewal Demands
At issue is the expiration of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other professional sports with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a view or a photo of the global icon.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a business model Jordan contended is unlawful to keep two hands on the wheel.
At issue for Jordan and a fellow team representative, who testified before Jordan, are details from September 2024. Gibbs described a frantic and emotional six hours where the sanctioning body informed teams they had to sign a contract extension. This agreement spanned 112 pages outlining pay for chartered teams and a guaranteed spot in every race.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.
The team owners reached out to Nascar about potential amendments or negotiations. Nascar refused to engage, according to his testimony.
The Bottom Line: Winning
Ultimately, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.
“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, sharing that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I dove in.”
Heather Gibbs’ Testimony
Gibbs described her request for permanent charters, which she said a written letter to Nascar. She testified the timing of the signature deadline was problematic.
She said, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Gibbs recounted was the message to Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If there are 30, I have 30.”
